Warning!
Recently there have been more and more cases of “theft” and attempts to change authorship of my audio assets.
Some very clever people re-upload my works under their own names and copyrights on the same sites from where they downloaded them.

Envato Elements License Terms
Envato Elements License Terms
An Item is not permitted to be used as part of an End Product where the primary component or value of the End Product is the Item itself.
You are not permitted to distribute an Item “as-is”, or otherwise make the Item available in its original form with only superficial changes, or minimal changes.
If the Item is a piece of music, the value of the End Product must not be predominantly derived from the music and instead, the value must stem from a combination of the music and other audio-visual elements. If it’s likely that people will click on the video to just listen to the music, it’s likely that the video is in breach of the license terms.
You would not be permitted to distribute or broadcast the ambient music as part of a Youtube video where that video is simply a single image or compilation of images with the music overlayed over the visual, with the title “Relaxing Music for Work”. In this instance, the music track would be the primary component as the user is seeking relaxing music to listen to and the video component is secondary.
Can I edit music items I download from Envato Elements?
Yes, you can. However, you cannot release music (even edited) as a music track. It must form a part of a larger project that is not merely a music track.
Do I need to relicense an item each time I use it?
Yes, you do. You need a license for each end project. This ensures contributors are paid for your usage of each asset & you and your clients have the legal right to use the item. Envato Elements Relicense Items instruction
![](http://d10j3mvrs1suex.cloudfront.net/s:bzglfiles/u/128465/0a352e5e12f9fc4ee4dc008b802c42a02980df09/original/screen2.jpg/!!/meta:eyJzcmNCdWNrZXQiOiJiemdsZmlsZXMifQ==)
In relation to YouTube it means: You need separate license for every video. You can’t use one “Elements license” on all videos. The Envato Elements license does not have a series policy. If you need to use a multi-use license, check out Envato AudioJungle whose license allows up to 52 episodes per year with one license.
Can I use music items for TV/Broadcast?
No, your Envato Elements subscription does not allow you to use music items for Broadcast use. Pursuant to our license terms, ‘Broadcast’ means:
- Traditional television or radio broadcast (e.g. terrestrial, cable or satellite TV, broadcast radio); or
- Mobile or online substitutes for traditional television or radio broadcast (e.g. mobile TV, IPTV streaming TV or video-on-demand, and streaming radio).
Your Envato Elements subscription does allow you to use music items for Indie Films, being a film not for general theatrical or broadcast use.
If you would like to use a music item for a broadcast project, you can purchase AudioJungle music items - with a suitable license for such use.
Can I create an End Product that is a music track from songs on Envato Elements?
No, you cannot create an End Product that is a music track with songs from Envato Elements.
Can I use music items downloaded from the Envato Elements library in YouTube videos?
This depends on how the music is used in the YouTube video. The value of the End Product (i.e. the video) must not be predominantly derived from the music; instead, the value of the End Product must stem from the combination of the music and the visual (as well as any other elements).
You would not be permitted to distribute or broadcast the music as part of a Youtube video where that video is simply a single image or compilation of images with the music overlayed over the visual. Example: with the title “Relaxing Music for Work”. In this instance, the music track would be the primary component as the user is seeking relaxing music to listen to and the video component is secondary.
If it’s likely that people will be clicking on the video mainly to listen to the music, it is likely that this video is in breach of the license.
Do I need to credit the author of the item?
No, it is not mandatory to give the author credit. But we do encourage that if your end product has credits as part of its design (such as a film or TV show), please credit the author and Envato. Also, as the author retains ownership of the item, you should not claim copyright.
Trademark & Copyright
Can I trademark something I have created using an Envato Elements item? (eg: a Logo)
This is not allowed. Your license for Envato Elements items is non-exclusive, meaning you cannot trademark an asset created using an item.
Can I claim complete ownership and authorship of something I have created using an Envato Elements item?
You cannot claim ownership or authorship for any item included in the end product that uses those items.
You are not permitted to claim any trademark or service mark rights for the End Product.

Music Item special terms
3. For Items other than fonts and add-ons, a Single Use is the use of the Item to create an End Product (requiring an application of skill and effort) in one of the following ways:
b. For an Item that is an audio item, the End Product is a sync of the music with an audio-visual or audio-only work that incorporates the Item as well as other things, so that it is larger in scope and different in nature than the Item.
9. You can modify or manipulate an Item, or combine the Item with other works, to suit your End Product. The resulting works created using the Item are subject to the terms of this license. You can do the things allowed in this clause as long as the End Product you then create using an Item is one that’s permitted under clause 3.
19. For music Items, the rights granted under this license are subject to the following restrictions:
d. The original author of the Item retains ownership of the Item. You can’t claim ownership of the Item, even if modified in accordance with this agreement, for example through content identification systems.
Example: if you use a music track synced in your video, you can’t claim rights to the music (e.g. through applying “Content ID” or similar systems to the music in your video).
28. The owner of each Item (the item author) retains ownership. You can’t claim ownership of an Item, even if modified under clause 9, for example through content identification systems.

Additional: AudioJungle license FAQ
Can I use music in an audio-only end product such as a podcast, audiobook, or guided meditation?
Yes, as long as the audio-only end product is larger in scope and different in nature than the music itself. As a rule of thumb, the music alone must not comprise the primary value of the end product, and should have speech overlayed and interspersed throughout. You can never distribute the music track as-is or with superficial modifications.
Example: You can use a relaxing music background to underscore your guided meditation voiceover recordings, and sell a CD of this to your spa customers.
Can I use an AJ track in a stand-alone music track?
You may not use music in stand-alone music tracks.
Example: You can't add lyrics to an audio track and sell it on iTunes

Envato generates licenses and creates conditions for their use. Elite Alliance monitors compliance with the conditions. An author is engaged only in content creation and takes only indirect participation in management. Hundreds of projects with my content are released every week, I cannot know and physically control them all. That's what a rights management agency is for.
When opening a dispute, claims are hidden from the author, I’ve no idea what is happening in the background until (IF) a manager contacts me regarding a specific request.
If a dispute has been opened, only an Elite Alliance manager can remove a claim.

Important announcement about YouTube Content ID
Read very carefully and think about the seriousness of what happened.
Unfortunately, for many very difficult reasons, I had to decide to register my portfolio with Content ID (starting December 7, 2023).
This is due to the fact that one of the scammers registered some of my tracks in the CID system and sent out illegal claims on someone else’s behalf. And as you understand, in such a situation, when someone else is managing my portfolio, I cannot influence the remove of claims. Hundreds of copies of collections with several dozen of my produced soundtracks have spread across dozens of streaming platforms (including YouTube Music).
This scammer didn't just take away monetization from my clients, he blocked their videos completely! Can you imagine the scale of the problems?
It was also recently discovered that my tracks were included in the soundtrack of a game distributed on the Sony PlayStation and Xbox console market without an appropriate license. And many more similar incidents occurred due to the fault of an individual who illegally used part of my portfolio.
The choice consisted of two options: allow the scammer to continue to use the false rights, who sent claims to my true clients and ruin my brand's reputation or deal with it at the legal level, confirm my rights and put the burden of checking licenses to rights management agency. What would you choose?
After I dealt with this problem at the cost of a lot of nerves and time, I was forced to protect my portfolio and my clients at least on the YouTube platform. To prevent thieves from taking audio fingerprints from tracks that don't belong to them and not sending out claims on someone else’s behalf. Even if this happens, now at least it will be faster and easier to deal with it than before.
From this moment on, I transferred the rights to manage my portfolio (~80%. excluding some logos, idents, several soundscapes and most percussion tracks) on YouTube Content ID to the Elite Alliance Music. All tracks on the Envato platform that came under the EAM's management were marked accordingly in advance.
To speed up the claims clearance process, you can always write to EAM team directly.

This method allows you to remove a claim faster than through a request in the YouTube author’s dashboard.
An author doesn’t make claims on YouTube; this is handled by a third party — a special agency for managing rights.
Hundreds of projects with my content are released every week, I cannot know about all of them.
When opening a dispute, claims are hidden from the author, I’ve no idea what is happening in the background until (IF) a manager contacts me regarding a specific request.
Any of the clients who have a current sync license(s) for my track(s) will be exempt from claims. Elite Alliance Music cooperates with Envato Elements\Envato AudioJungle and strictly complies with licensing agreements. The rules of the license agreement are set by Envato, NOT by the authors.
> Information about Envato license restrictions <
Before opening a dispute, study information about correct registration of items.
There is a big difference in licenses depending on which of the two platforms you purchased it on. The Elements license is much more limited than the Audiojungle license.
"You can’t re-distribute the Item as a musical item, as stock, in a tool or template, or with source files. You can’t do this with an Item either on its own or bundled with other items (such as an audio compilation), and even if you modify the Item. You can’t re-distribute the Item as-is or with superficial modifications. These things are not allowed even if the re-distribution is for free."
Examples: You can’t modify a music track and distribute it on a music CD. You can’t add lyrics over the top of a music track and sell it as your own song on iTunes.

Envato Elements License FAQ
If your dispute involving an Envato Elements license was rejected, you probably did not use the license correctly. The most common mistake in 99% of cases is using one license for all videos. You need to register each video separately. This is Envato’s requirement. Otherwise, the system that distributes fee from your subscription will not correctly distribute royalties among all the authors from whom you uploaded content.
Envato Relicense-Items instructions
"Envato provide license certificates for audio you download on Envato Elements and AudioJungle, so should a copyright notice appear on a video containing music that is tracked by Content ID, it can be easily cleared."
